+== Yellow Corp. escapes WARN Act payouts ==
 +
 +Todd Maiden - Mon, June 29, 2026 at 2:46 PM PDT
 +
+Bankrupt Yellow Corp. is not liable for failing to give 60 days' advance notice to its 22,000 union employees ahead of mass layoffs in 2023, according to a Monday ruling from the U.S. District Court in Delaware. The court affirmed a federal bankruptcy court's previous decision, adding some minor exceptions.
 +
+The bankruptcy court previously ruled that the former less-than-truckload carrier qualified for an exemption to WARN Act requirements as it was a "liquidating fiduciary" winding down affairs, not an operating business, at the time of the layoffs. The prior ruling said Yellow didn't qualify under a "faltering company" exception due to a technical error. The actual layoff notices issued to employees in July 2023 weren't detailed and didn't fully explain why the company was closing, voiding the faltering company defense, the ruling said.
 +
+That decision also said Yellow appeared to act in good faith and that if the court was found incorrect on its view of the WARN requirements, back pay and benefits should be limited to just 14 days, not the 60 days requested.
 +
+The Monday ruling affirmed the bankruptcy court's finding that "Yellow is not liable to the union members under the WARN Act," and noted that Yellow did satisfy the requirements to qualify as a faltering company. The ruling also affirmed the bankruptcy court's decision that Yellow was an employer under New Jersey law at the time of the layoffs. Any potential payouts to New Jersey employees were not quantified.

-John Kingston - Fri, January 3, 2025 at 11:14 AM PST
-
-An earlier dispute between project44 and MyCarrier has been extended to bring in SMC3, as the provider of freight visibility now accuses SMC3 of theft of intellectual property.
-
-The lawsuit by project44 (p44) was filed Tuesday in the U.S. District Court for the Northern District of Georgia.
-
-Project44’s lawsuits against MyCarrier and SMC3 may be separate pieces of litigation, but they are effectively linked in describing the sequence of events that led to their filings.
-
-
-According to the lawsuit, MyCarrier had a five-year agreement with p44 that enabled MyCarrier to offer p44’s functionality through the MyCarrier transportation management system. It was signed in 2023.
-
-The deal would allow MyCarrier “to offer the [p44’s] features to its customers, who are typically small to medium shippers of goods without their own TMS platforms of logistics departments.”

+== Mercedes posts Tesla-like efficiency hauling 36 tons through a German winter ==
 +
 +Jo Borrás - Jun 27 2026 5:48 am PT
 +
+Despite the rapidly growing number of heavy-duty EVs on western roads, a number of myths still persist about range, charging infrastructure, and economic viability. To combat those myths, Mercedes-Benz is sharing real-world data from 80 of its deployed electric semi trucks. Here’s what they found.
 +
+The data released by Mercedes-Benz covers 80 battery-electric heavy trucks deployed in the company’s own logistics fleet over thousands of trips, thousands of charging cycles, and millions of miles. Their conclusion: electric long‑haul transport is viable today.
 +
 +<blockquote>
+    A real‑world example from the Ulm‑based logistics company Seifert illustrates a route between Wörth am Rhein and Bielefeld. An eActros 600 with an average gross combination weight of 36 metric tons achieves a daily mileage of around 600 km, with approximately half of the charging events taking place at public charging points. On this route, the electric truck also achieves toll savings of more than €4,000/mo. Annually, this route saves 90 metric tons of CO2e. Average energy consumption between November and February is 100 kWh per 100 km, which is equivalent to approximately 11 liters of diesel.
 +
+    The data demonstrate that demanding long‑distance routes can already be operated reliably and predictably on this route using today’s public charging infrastructure and economically as well, when TCO is considered.
